New blow to Rojadirecta: the Supreme Court endorses the closure of the website in Spain

It all started in 2016, when the Commercial Court of A Coruña ruled that Rojadirecta should stop linking with unauthorized streams of football events, its main business model. This order came after a complaint by Mediapro and DTS, who were the ones who had the rights to these sporting events.

In this case, Rojadirecta had no choice but to close access to Spanish visitors, but before that it appealed the decision to the Provincial Court of A Coruña in 2018. It did not achieve its objective either, so He opted to appeal to the Supreme Court, hoping that it would take up the case.

The future of Rojadirecta, increasingly uncertain

Finally, The Supreme Court has decided to dismiss the proceeding indicating in its verdict that the statement that Rojadirecta’s activity infringed intellectual property is true, so the website will remain closed, rejecting the petition.

According to the founder of Rojadirecta, the web is simply a neutral intermediary that indexes third-party content. However, the A Coruña court classified it as a content provider. And it seems that the Spanish justice does not intend to give its arm to twist.

Rojadirecta’s remaining options are rather few, since you can only go to the Constitutional or the European Court of Human Rights in Strasbourg. Let us remember that Rojadirecta also has a criminal lawsuit in which the founder of this portal faces a sentence of up to four years in prison.
