PornHub strikes back! The porn site has just launched reprisals against Arcom, which is doing everything possible to block X platforms in France. PornHub addressed the Constitutional Council.
France seems determined to block porn sites. In March, Arcom took legal action to request the blocking of PornHub, Xvideos, Porndig, xHamster and Xnxx. The Audiovisual and Digital Communication Regulatory Authority has put the sites on notice to force them to set up a method of verifying the age of the visitor.

PornHub opposes the blocking of X sites
Aware that Arcom does not intend to drop the case, PornHub has decided to launch a counterattack. Site X has just challenged the legality of the blocking procedure with the Constitutional Council, report our colleagues from NextInpact. The porn site questions the legality of the legal disabling of age disclaimers in the Penal Code, under the “ principle of legality of offenses and penalties ” and of “ freedom of expression and communication “.
Concretely, the site is trying to prove that the blocking attempt that targets pornographic video platforms is contrary to the French constitution. The company MG Freesites Ltd, which publishes the PornHub site, ensures that “ these provisions do not define in sufficiently clear and precise terms a criminal offense and the conduct which may give rise to a sanction having the character of a punishment “.
The company also believes that blocking X sites represents “an attack that is not necessary, appropriate and proportionate to the objective pursued by the legislator of preventing access by minors to pornographic content on the Internet”.

According to information from the media, other sites are currently fomenting a similar counter-attack. “Appeals to the Council of State are well on their way, against the implementing decree and the formal notices”, emphasizes NextInpact. Porn sites seem determined not to let this happen.
