Home Office: Falling while walking from bed to desk is considered a work-related accident and insurance can be claimed

The Covid-19 pandemic caused a large part of the world’s population to adapt to the Home Office, that is to say, work from the comfort of your home, a place where it is practically impossible for a work mishap. Therefore, there would be no possibility of claiming the accident insurance.

However, imagine that you are working at home, you fall when walking from bed to your desk and you claim said insurance from your company because you suffered a work accident. Sounds ridiculous, right? However, this is completely real … at least in Germany.

The Federal Social Court that country determined that a man who slipped while walking from his bed to his home ‘office’ may claim accident insurance. This was decided by the Senate of the court in file ‘B 2 U 4/21 R’.

According to the document, the subject worked from his home and went to his desk downstairs. However, as he walked by his spiral staircase, which connects with the rooms, slipped and broke a thoracic vertebra (middle part of the back).

The Federal Social Court of Germany indicated that, as expected, the defendant professional association refused to cover insurance. However, the court considered that the trip made by the individual was “an assured work route”, so “the plaintiff’s appeal was successful”.

“If the insured activity takes place in the home of the insured or elsewhere, the insurance coverage it is provided to the same extent as when the activity is carried out on the company’s premises, “the court explained.
