The association filed a complaint with the Investigating Courts of Valencia for crimes of fraud, misappropriation and others, against PSM, an individual and the company against whom it acted on behalf of a group of affected parties. The court admitted the complaint and proceeded to point out evidence, transferring the complaint and summoning the defendants to testify.

Given the risk of conviction in the criminal procedure, the defendants, together with their lawyers, They reached an agreement with the lawyers of those affected, represented by the AAIC. With it, compensation has been achieved to the full satisfaction of the claims of all those affected represented. In exchange, the association withdrew the complaint after receiving the payment.

This is a hopeful first step, but we must continue to defend those affected. The only way to get justice for this type of cryptocurrency fraud is to file collective lawsuits. Fraudsters take advantage of the legal vacuum in which cryptocurrencies find themselves until the European regulation that regulates them, called MiCa, is approved. It is necessary to create a regulatory body, such as the National Securities Market Commission (CNMV) or the Bank of Spain, but independent, in addition to promoting the specialization and training of judges and lawyers in cryptocurrencies. In addition, it is urgent to regulate misleading advertising, put emphasis on the legal security of transactions and promote training and information about cryptocurrencies and familiarization in their use, for example, regulating the places from which small transactions can be carried out “Zaballos concluded.
